interfacewithoutproblemswithyourcomputersystem.Itisyourresponsibilitytoback

uporotherwisesaveimportantdatabeforeinstallinganystoragesystemandcontinueto

backupyourimportantdataregularly.

Nootherdocument,statementorrepresentationmaybereliedontovarythetermsof

thislimitedwarranty.

Promise’ssoleresponsibilitywithrespecttoanystoragesystemistodooneofthe

following:

a. replacethestoragesystemwithaconformingunitofthesameorsuperiorproduct;

b. repairthe storagesystem.

Promiseshallnotbeliableforthecostofprocuringsubstitutegoods,services,lostprofits,

unrealizedsavings,equipmentdamage,costsofrecovering,reprogramming,or

reproducingofprogramsordatastoredinorusedwiththestoragesystems,orforany

othergeneral,special,consequential,indirect,incidental,orpunitivedamages,whether

incontract,tort,orotherwise,notwithstandingthefailureoftheessentialpurposeofthe

foregoingremedyandregardlessofwhetherPromisehasbeenadvisedofthepossibility

ofsuchdamages.Promiseisnotaninsurer.Ifyoudesireinsuranceagainstsuchdamage,

youmustobtaininsurancefromanotherparty.

Somestatesdonotallowtheex clusionorlimitationofincidentalorconsequential

damagesforconsumerstoragesystems,sotheabovelimitationmaynotapplytoyou.

Thiswarrantygivesspecificlegalrights,andyoumayalsohaveotherrightsthatvaryfrom

statetostate.ThislimitedwarrantyisgovernedbytheStateofCalifornia.



6.3SparePartsWarranty

Promisedoesnotprovideawarrantyforsparepartsexceptassetforthexpresslyherein.

Installationofasparepartinastoragesystemdoesnotaf fecttheproduct’sremaining

warrantyterm.PromisewarrantsonlythatallnewsparepartswillnotbeDOA.Ifanew

sparepartisfoundtobedefectiveuponreceipt,youmaycontactyourlocaldistributoror

PromiseTechnologywithinthirty(30)daysofreceiptandobtainareplacementsparepart.

Acopyoftheoriginalpurchaseinvoiceandthedef ectivepartmustaccompanyallsuch

requestsforreplacementspareparts.


