b. ThestoragesystemshallbeROHS,WEEE,ISO14001andREACHcompliant,andallthe

componentsusedwithinthesystemshalleliminatetheadoptionofhazardous

materialslikePb,Cd,Br,andHalogensatalllevels.

6Warranty

6.1LimitedWarranty

PromiseTechnology,Inc.(“Promise”)warrantsthatforthree(3)yearsfromthetimeof

thedeliveryofthestoragesystemtotheoriginalenduserexceptforone(1)year

warrantyonthebatterybackupunit:

a. thestoragesystemwillconformtoPromise’sspecifications;

b. thestoragesystemwillbefreefromdefectsinmaterialandworkmanshipunder

normaluseandservice.

Thiswarranty:

appliesonlytostoragesystemswhicharenewandincartonsonthedateofpurchase;

a. isnottransferable;

b. isvalidonlywhenaccompaniedbyacopyoftheoriginalpurchaseinvoice;

c. isnotvalidonspareparts.

Thiswarrantyshallnotapplytodefectsresultingfrom:

a. improperorinadequatemaintenance,orunauthorizedmodification(s),performedby

theenduser;

b. operationoutsidetheenvironmentalspecificationsforthestoragesystem;

c. accident,misuse,negligence,misapplication,abuse,naturalorpersonaldisaster,or

maintenancebyanyoneotherthanaPromiseoraPromiseauthorizedservicecenter.



6.2DisclaimerofOtherWarranties

Thiswarrantycoversonlypartsandlabor,andexcludescoverageonsoftwareitemsas

expresslysetabove.

Exceptasexpresslysetforthabove,PromiseDISCLAIMSanywarranties,expressedor

implied,bystatuteorotherwise,reg ardingthestoragesystem,including,without

limitation,anywarrantiesforfitnessforanypurpose,quality,merchantability,

non‐infringement,orotherwise.Promisemakesnowarrantyorrepresentation

concerningthesuitabilityofanystoragesystemforusewithanyotheritem.Youassume

fullresponsibilityforselectingstoragesystemsandforensuringthatthestoragesystems
